Details of this critical opening follow: RESPONSIBILITES: BASIC FUNCTION: Handle claims of high complexity requiring a high degree of technical expertise, including litigated matters and coverage issues. Incumbents must be technically competent as to require minimum direction from Team Leader. ESSENTIAL FUNCTIONS: 1. Handle claims of high complexity with specific emphasis on primary and umbrella construction defect claims. 2. Confirm coverage by reviewing policies and documents submitted in support of claims. Analyze coverage and communicate coverage positions, as warranted, under direction of Team Leader. 3. Conduct, coordinate and direct investigation into facts of the loss and nature/extent of the damages and/or injuries. Obtain documentation of special damages and other damages as required by the nature of the claim. Develop and implement remedial action. 4. Evaluate information on contractual coverage, liability and damages, including technical expert surveys and reports, to determine the extent of exposure to the insured. 5. Document investigation, evaluation, strategies and resolution of claims through reports, file comments, correspondence, memos and other similar means of communication. 6. Set reserves within authority or recommend appropriate reserve changes to Team Leader. Continue to monitor reserves for adequacy as information develops. 7. Bring claims to conclusion by communicating contractual coverage and liability positions and entering into negotiations, where appropriate, including arbitration, mediation and other ADR methods of settlement. Obtain settlement documents including releases, proofs of loss, etc. and issue payments as appropriate. 8. Direct and evaluate litigated matters to determine future course of handling and proper methods of resolution. 9. Direct and work closely with outside counsel and experts towards evaluation of exposure and appropriate resolution of claims. 10. Maintain individual diary control of all files assigned for accountability, timely review and appropriate action. 11.Work with Team Leader on claims in excess of authority and bring to Team Leader's attention any claims in which information developed indicates exposure that is in excess of authority and/or adverse or unusual factual developments which otherwise affect exposure. 12. Travel to attend conferences, trials, mediations, etc. as necessary. 13. Identify reinsurance and/or recoverable issues and assist in collection as necessary. 14. Confer with team members on issues such as procedures, assignments, workflow and developing trends within the claims/legal environment. 15. Confer with and support underwriters on issues including coverage provisions, appropriate law and technical scientific issues related to potential exposure. MARGINAL FUNCTIONS: 1. Utilize the PC for entry of claims information and communication. 2. Use PC tools such as Word, spreadsheets etc. for communication, documentation and organizational purposes. 3. Perform special projects and assignments as requested. ACCOUNTABILITY: Accountable for handling and control of all claim matters assigned including investigation, evaluation, disposition, reserve accuracy and diary maintenance. ORGANIZATIONAL RELATIONSHIPS: 1. Report to and receive specific authority from manager or Team Leader. May have some supervisory responsibilities. 2. Work within a team structure, giving and receiving assistance. POSITION QUALIFICATIONS: 1. College degree. 2. Law degree preferred but not required. 3. If not licensed, a Georgia adjuster's license must be obtained within a reasonable time after beginning employment. 4. Minimum ten years of claim handling or equivalent experience in area of specialty claims to be handled including knowledge of torts, contracts, and law along with a working knowledge of long term exposure claims with an emphasis on primary and umbrella construction defect claims. 5. Ability to work independently, and assimilate learning materials on many different subjects from various sources, as evidenced by successful completion of college level curriculum and work experience. 6.
