A. This is an Agricultural Labor Program clearance order for temporary or seasonal agricultural workers. ALL QUALIFIED U.S. DOMESTIC WORKERS (CITIZENS AND NON-CITIZENS WITH VALID WORK AUTHORIZATION) INCLUDING MSFW AND NON-MSFW WORKERS MAY BE REFERRED.
B. Interested applicants should report to any State Workforce Agency (SWA) career center for help in contacting the employer. Referral by a career center provides program guarantees and protections that may not be available to a worker not referred. Workers must have valid identification for I-9 preparation when they report to the employer location to begin work. The employer may use the U.S. Citizenship and Immigration Services E-Verify Program to verify employment eligibility.
C. Workers referred to this job by a SWA should report to a career center between 5 and 9 work days before the job start date to verify the job start date is the same. Failure to do so may disqualify the worker from the assurances of this Job Order.
Worksites are located in Sunflower & Humphreys Counties Mississippi. The housing is in Sunflower County Mississippi.
D. Job Offer: 3 general farmworkers. Job requires the operation of various tractors and farm equipment to till soil; work ground; prepare and maintain land; and plant, irrigate, fertilize, spray, cultivate, and harvest crops. Equipment that
workers may be required to operate includes, but is not limited to, tractors with various implements, equipment that utilizes John Deere GPS and auto systems (Green Star 3000 and 6000), sprayers,
combines, back-hoes, mowers, track-hoes, and ATVs/side by sides. Workers need to have knowledge of irrigation pipe planner. Irrigation activities include participating in laying pipe, walking length of
irrigation pipe to puncture it at set intervals, setting up and operating irrigation equipment, clearing and maintaining irrigation ditches, operating well motors, operating and maintaining pivots, draining
excess water from fields, and monitoring fields to check on and maintain adequate water supply to crops. Employees will also perform duties including but not limited to loading seed into planters;
properly mixing chemicals; loading chemicals into sprayers; changing combine cutting heads; rouging fields and using hand tools to remove undesirable plant varieties, trash, and other objects from
fields; welding; cutting torches or other similar equipment; performing general maintenance, repairs and/or clean-up of storage sheds, pivot points, buildings, barns and all farm equipment; ensuring
operational areas are organized and well maintained; using hand tools and equipment to repair, clean and maintain farm vehicles, machinery and specialized machinery and agricultural equipment;
regularly servicing equipment; mowing and landscaping around the farm; lifting as needed; maintaining pond levees, feeding fish, testing to measure the oxygen levels; and maintaining aerators. Duties
also include receiving crop for drying and storage at grain storage facility; disposing of spoiled grain; transporting grain from fields to grain bins; loading and unloading grain into trucks while keeping
grain level; operating augers and grain conveying equipment; monitoring grain moisture levels; preparing scale tickets; shoveling grain; and other activities that may be required in the harvesting, storage
and shipping of grain or other crops. There are few typical days and workers may be required to change duties and/or locations often and engage in various general functions. Daily duties may vary
depending on crop, weather, and field conditions. The employer reserves the right to increase workers' pay or provide bonuses based on tenure, performance, or other factors that are solely based on
the discretion of the employer.
Pay - Adverse Effect Wage Rate (AEWR): $14.83 per hour guarantee.
Guarantee is in effect.
Wage Offer: $14.83 per hour

Bonus: None.
Pay is: Weekly.
Employer provides tools/equipment.
Withholding: Federal Income Tax, Social Security and Medicare, and any deductions agreed to by the worker in writing.

E. Contract period is February 20, 2025 to November 22, 2025.
Hours: 64 hours per week
Days/Hours: Monday thru Saturday 10.66 hours per day.
Work may be offered but not required on Sundays and holidays. Extra work hours may be offered based on weather and other conditions.
F. Employer will refund workers living outside commuting distance the reasonable transportation and subsistence costs to report for the first day of work on the 50% date. Will provide workers who complete the contract period the reasonable cost of transportation and subsistence to return to place of recruitment or to report to the next H-2A job.
G. Housing and Board: See ETA 790.

Housing meets the requirements of Federal, State and Local regulations. Rules regarding living accommodations will be found in the Clearance Order. Transportation provided by the employer meets the requirements of Federal, State and Local regulations.
H. Prohibition against preferential treatment of aliens: The employer's job offer must offer to U.S. workers no less than the same benefits, wages, and working conditions that the employer is offering, intends to offer, or will provide to H-2A workers. Job offers may not impose on U.S. workers any restrictions or obligations that will not be imposed on the employer's H-2A workers. This does not relieve the employer from providing to H-2A workers at least the same level of minimum benefits, wages, and working conditions which must be offered to U.S. workers.
